2. Collection and storage of personal data and the type and purpose of their use

While visiting our websites www.md-law-luecker.com and www.mp-recht.de, the browser used on your device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information will be collected without your intervention and stored until automated deletion:

  • IP-Address of your computer,
  • Date and time of your access
  • Name and URL of requested, visited websites and data
  • The requesting Website (Referrer-URL),
  • Used browser and occasionally the operating system of your computer and the name of your access-provider.

 Those data will be used for the following purpose:

  • To warrant a smooth website connection
  • To warrant a comfortable use of our website
  • To evaluate the system security and stability as well as
  • Additional pure administrative purpose.
The legal basis for data processing is Art. 6 para. 1 s. 1 lit. f Regulation 2016/679 (European General Data Protection Regulation / GDPR). Our legitimate interest follows from the data collection purposes listed above. In no case we use the collected data for the purpose of drawing conclusions about you.


3. Disclosure of data

There will be no transfer of your personal data to third parties for purposes expect those listed below.
We will disclose your transferred data to third parties only in case of:

  • You have consented to the disclosure in accordance to Art 6 para. 1, s. 1 lit. a. GDPR,
  • The disclosure is required in accordance to Art 6 para. 1, s. 1 lit. f. GDPR to assert, exercise or defend legal claims and there is no reason to believe that you have an overriding justified interest in not disclosing your data,
  • in the event that the disclosure is a legal obligation pursuant to Art. 6 para. 1 s. 1 lit. c. GDPR, or
  • legally permissible situation and according to Art. 6 para. 1 s. 1 lit. b. GDPR it is required for the settlement of contractual relationships with you.


4. Cookies

We use cookies on our site. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not harm your device, do not contain viruses, Trojans or other malicious software.

Cookie will store information, each resulting in connection with the specific device used. However, this does not mean that we are immediately aware of your identity.

You have the following rights:

  • In accordance with Art. 15 GDPR, you may request information about your personal data processed by us. In particular, you can ask for information on the processing purposes, the category of personal data, the categories of recipients to whom your data has been disclosed, the planned retention period, the right to rectification, deletion, limitation of processing or opposition, the existence of your right to complain, the source of your data, if not collected from us, and the existence of automated decision-making, including profiling, and, where appropriate, meaningful information about their details;
  • In accordance with Art. 16 GDPR, you can demand the correction of incorrect or completed personal data stored on our behalf without delay, demand decision-making including profiling and, if necessary, meaningful information on their details;
  • In accordance to Art. 17 GDPR you can request the deletion of your stored data, as far as not required to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, pursue or defend legal claims;
  • In accordance to Art. 18 GDPR, you may demand the restriction of the processing of your personal data, as far as the accuracy of the data is disputed by you, the processing is unlawful, but you reject its deletion and we no longer need the data, but you assert this for exercising or defending legal claims or you have objected to the processing in accordance with Art. 21 GDPR;
  • In accordance to Art. 20 GDPR, you may demand to receive your personal data provided to us in a structured, standard and machine-readable format or to request transmission to another person in charge;
  • In accordance to Art. 7 para. 3 GDPR, you can revoke your once given consent to us at any time. As a result, we are no longer allowed to continue the data processing based on this consent for the future, and
  • In accordance to Art. 77 GDPR you may bring yours complain to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or work or our place of business.


6. Right Of Objection

If your personal data are processed in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR based on legitimate interests, you have the right to file an objection against the processing of your personal data in accordance with Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct mail. In the latter case, you have a general right of objection, which is implemented by us without specifying any particular situation.

7. Data Protection

We only provide data and no data is collected, stored or processed any of your data on our website. In this respect, there is no encryption of the transmission of the offered data.
We also take appropriate technical and organizational security measures to protect our data against accidental or intentional manipulation, partial or total loss, destruction or against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

This Privacy Statement is valid and has the revision date: May 2018

As a result of the further development of our website and offers thereof or due to changed legal or official requirements, it may be necessary to change this Data Protection and Privacy Statement.
